Terms and conditions

Last updated: October 2026

These terms apply to all building, bathroom renovation, garden design and landscaping work we carry out for you. Please read them before you accept a quote. Nothing in these terms affects your legal rights as a consumer.

1. About us

We are Koniu Construction Ltd, a company registered in England and Wales with company number 11968442. Our registered office is 4 Gables Court, 239-241 Malden Road, London SM3 8EQ. You can contact us on 07719 664 615 or at koniuconstruction@gmail.com.

2. Quotes and the contract

2.1 After a site visit we will give you a written quote describing the work, the materials included, the price, the payment stages and the expected start date and duration. Quotes are valid for 30 days unless they say otherwise.

2.2 A contract is formed when you accept our quote in writing, including by email or message. Your quote, any drawings or specification we agree, and these terms form the contract between us.

2.3 We are not registered for VAT, so no VAT is added to our prices.

2.4 Where the quote includes a provisional sum or a prime cost sum, for example for tiles, sanitaryware, paving or plants that you have not yet chosen, the final price will be adjusted to the actual cost, and we will show you this cost before ordering.

3. Changes and extra work

3.1 If you ask for changes to the work, we will tell you the effect on the price and the programme, and we will confirm the change in writing before we carry it out.

3.2 If, once work has started, we find something that could not reasonably have been seen or known before, such as rotten joists, hidden pipework, defective drainage, poor ground conditions, buried obstructions or asbestos, we will stop that part of the work, explain the problem and the cost of putting it right, and we will not carry out extra work without your agreement.

4. Your responsibilities

4.1 Please give us safe access to the property and work areas during normal working hours, Monday to Friday 8am to 6pm and Saturday 8am to 1pm unless we agree otherwise, and access to water, electricity and a toilet.

4.2 Please remove or protect furniture, valuables and anything else in or near the work area. We will protect floors and surfaces along our access route.

4.3 Unless we agree in writing to arrange them, you are responsible for obtaining any planning permission, listed building or conservation area consent, landlord or freeholder consent, and for any notices needed under the Party Wall etc. Act 1996.

4.4 Where Building Regulations apply to the work, we will tell you before work starts how compliance will be dealt with, either through a registered competent person scheme or through building control.

4.5 Please tell us before we start about anything you know that could affect the work, such as the location of underground services, drains and boundaries, or any known asbestos.

4.6 Where you supply materials yourself, such as tiles, fittings or paving, you are responsible for ordering the right quantity, for their quality and for delivering them on time. We are not responsible for defects in materials you supply, but we will tell you if we notice a problem before fitting them.

5. Programme and delays

5.1 Start dates and durations in our quote are our best estimate. We will keep you informed of progress and of anything that is likely to cause a delay.

5.2 We are not responsible for delays caused by events outside our reasonable control, such as severe weather, frost or heavy rain affecting groundworks and paving, supplier delays, or delays caused by changes you request or by lack of access.

6. Payment

6.1 We may ask for a deposit before the work starts, to cover materials ordered specially for your project. The deposit and the stage payments are set out in your quote.

6.2 Stage payments are due when each stage set out in the quote is completed. The final payment is due on practical completion, when the work is finished apart from minor snagging items that do not stop you using the room or garden. We may hold back a small agreed sum until snagging is complete.

6.3 If a consumer pays late, we may charge interest on the overdue amount at 4% a year above the Bank of England base rate. If a business customer pays late, we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998. We may also pause work while payment of an invoice that is due is outstanding, after giving you seven days’ written notice.

6.4 Materials remain our property until they have been paid for in full.

7. Your right to cancel

7.1 If you are a consumer and you agreed the contract with us away from our premises, for example at your home, by phone or online, you have the right to cancel within 14 days of the day after the contract was made, without giving a reason.

7.2 To cancel, tell us clearly by phone, by email to koniuconstruction@gmail.com, or in writing to our registered office. You can use the model cancellation form below, but you do not have to.

7.3 We will not start work during the 14-day cancellation period unless you ask us to in writing. If you ask us to start during that period and then cancel, you will need to pay for work carried out up to the time you tell us you are cancelling, and for any materials made or ordered to your specification that cannot be returned.

7.4 If you cancel, we will refund any payment due to you within 14 days of being told about the cancellation, using the same payment method you used.

Model cancellation form: To Koniu Construction Ltd, 4 Gables Court, 239-241 Malden Road, London SM3 8EQ, koniuconstruction@gmail.com. I hereby give notice that I cancel my contract for the supply of the following service: [description]. Ordered on: [date]. Name: [your name]. Address: [your address]. Signature (if on paper): [signature]. Date: [date].

8. Site, waste and tidiness

We will keep the work area as safe and tidy as reasonably possible, clear our waste regularly and dispose of it through licensed waste carriers. Where a skip or materials need to be placed on the road, we will obtain the permit from the council, and the cost will be shown in the quote.

9. Natural materials and planting

9.1 Natural stone, timber and many tiles vary in colour, texture and veining from one piece to another and from the samples shown. This natural variation is not a defect.

9.2 New planting and turf need regular watering and care, particularly in their first growing season. We will give you aftercare advice. We cannot be responsible for plants or turf that fail because of lack of watering, drought, frost, pests or disease after handover.

10. Our guarantee

10.1 We carry out all work with reasonable care and skill and using materials of satisfactory quality. We guarantee our workmanship for 12 months from completion. If a defect caused by our workmanship appears in that time, tell us and we will return and put it right free of charge.

10.2 Products such as showers, brassware, sanitaryware and underfloor heating also come with the manufacturer’s guarantee.

10.3 Our guarantee does not cover fair wear and tear, misuse, lack of maintenance, accidental damage, work by others, normal shrinkage or settlement, or existing parts of the property that we did not work on.

10.4 Our guarantee is in addition to your legal rights. Under the Consumer Rights Act 2015, services must be carried out with reasonable care and skill, and any information we give you about the service is binding. If we do not meet these standards, you can ask us to put things right or, in some cases, ask for a price reduction. Citizens Advice can tell you more about your rights.

11. Our responsibility for loss or damage

11.1 If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. We hold public liability insurance.

11.2 We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for breach of your legal rights as a consumer.

11.3 If you are a business customer, we are not liable for loss of profit, loss of business or indirect losses, and our total liability for any project is limited to the contract price, except where the law does not allow us to limit it.

12. Ending the contract

Either of us may end the contract by written notice if the other seriously breaks these terms and does not put it right within 14 days of being asked to. If the contract ends, you will pay for work properly carried out and materials ordered for your project up to that date.

13. Complaints

If you are unhappy with any part of our work, please follow our complaints procedure, which is published on this website.

14. Your personal information

We use your personal information as set out in our privacy policy.

15. General

These terms, together with your quote, form the whole agreement between us. If a court finds part of these terms invalid, the rest will continue to apply. These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales.
